Terms and Conditions with Customer Information

1) Scope of Application These General Terms and Conditions (hereinafter "GTC") of Aster Gastronomies, Rohrerstraße 13, 39058 Sarntal (hereinafter "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") enters into with the Seller regarding the goods offered in the online shop at www.speckbox.it. Deviations from the Customer's terms are not accepted unless expressly agreed to by the Seller.

A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur within the meaning of these GTC is any natural or legal person, or any partnership with legal capacity, that acts in the exercise of their commercial or independent professional activity when entering into a legal transaction.

2) Conclusion of the Contract The product descriptions contained in the online shop do not constitute binding offers but serve as an invitation to make a binding offer by the customer.

The customer can make the offer via the integrated order form in the online shop. By submitting the order, the customer makes a legally binding offer to conclude a purchase contract.

The Seller may accept the offer within five days by:

  • written order confirmation (e.g., by email),
  • delivery of the goods, or
  • request for payment from the customer. If the Seller does not accept the offer within this period, the offer is considered rejected.

If payment is made via "PayPal Express," the Seller accepts the contract when the customer issues the payment instruction.

3) Right of Withdrawal Consumers are generally entitled to a right of withdrawal. Further information can be found in the Seller's withdrawal instructions.

4) Prices and Payment Terms All prices are total prices including statutory VAT. Shipping costs are shown separately.

For international deliveries, additional costs such as customs duties or exchange rate fees may apply, which are to be borne by the customer.

The available payment methods are displayed in the online shop.

In case of advance payment, the payment is due immediately after the conclusion of the contract.

5) Delivery and Shipping Conditions Delivery will be made to the address provided by the customer.

If the goods cannot be delivered and are returned to the Seller, the customer bears the costs of the unsuccessful delivery unless they are not responsible for the non-delivery.

6) Retention of Title The goods remain the property of the Seller until full payment is made.

7) Warranty (Defects Liability) The statutory warranty rights apply.

Obvious transport damages must be reported to the carrier and the Seller. This does not affect the statutory warranty rights.

8) Alternative Dispute Resolution The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

The Seller is not obligated to participate in dispute resolution procedures before a consumer arbitration board.

9) Place of Performance and Jurisdiction The place of performance for all obligations arising from the contractual relationship is the Seller's place of business. If the customer is a merchant, a legal entity under public law, or a special public law entity, the exclusive jurisdiction for all disputes arising from this contract is the Seller's place of business. The same applies if the customer does not have a general place of jurisdiction in the EU or if their place of residence or habitual abode is unknown at the time the lawsuit is filed.
